These Terms and Conditions ("Terms") govern your use of the website owenswater.com (the "Site") operated by Owens Water Co., LLC ("we," "us," "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Detailed Provisions
2. ABOUT OUR SERVICES
Owens Water Co., LLC is a Florida-registered water treatment company headquartered in Bonita Springs, Florida. We sell and arrange the installation of residential and commercial water treatment products including whole-home water softeners, reverse osmosis drinking water systems, pre-sediment filters, and replacement filters. We provide ongoing customer service, recurring filter delivery, warranty administration, and project coordination. Our service area includes Lee, Collier, and Charlotte counties, Florida.
IMPORTANT: Owens Water Co., LLC is NOT a licensed plumbing contractor. All physical installation work is performed by independently licensed and insured plumbing contractors with whom we partner. We coordinate scheduling, manage the project, and provide warranty support, but we do not personally perform installation services.
3. ELIGIBILITY AND USE
You must be at least 18 years old to use the Site and request services. You must provide accurate and complete information when submitting forms. You agree not to misuse the Site (including, but not limited to, attempted hacking, scraping, or fraudulent submissions).
4. PRODUCT INFORMATION AND PRICING
Product specifications, pricing, and availability are subject to change without notice. Pricing quoted on the Site is for general informational purposes; final pricing is provided in a written quote after consultation. We reserve the right to refuse service for any reason. All sales are governed by the separate written sales contract you sign at the time of purchase, which controls in case of conflict with these Terms.
5. INSTALLATION AND THIRD-PARTY CONTRACTORS
COMPLIANCE NOTICE: Installation is performed by independent licensed and insured plumbing contractors we coordinate with on your behalf. These contractors carry their own liability insurance and are responsible for the quality and safety of installation work. We are not the employer of installation contractors and are not liable for their independent actions, negligence, or omissions. Any installation-related disputes are subject to the terms of the contractor's own service agreement and applicable Florida law.
6. WARRANTY
Our products are backed by a Lifetime Warranty as described in our written Warranty Statement, available upon request. The Warranty Statement is a separate document and controls in case of conflict with these Terms. The Warranty covers defects in materials and workmanship of the product. The Warranty does NOT cover: misuse, neglect, damage from extreme conditions, modifications not approved by us, or installation by parties other than our authorized plumbing partners. Implied warranties are limited to the duration of the express warranty to the maximum extent permitted by Florida law.
7. CUSTOMER FINANCING
We offer financing through our third-party partner Foundation Finance. Financing approval, terms, and rates are determined by Foundation Finance, not by Owens Water Co. Owens Water Co. is not responsible for Foundation Finance's lending decisions or terms.
8. DISCLAIMERS
The Site and our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind beyond those expressly stated. We do not warrant that the Site will be uninterrupted, error-free, or secure. We do not warrant any specific health or wellness outcomes from our water treatment products. Water quality varies by home and source; we make no guarantee about your specific water analysis without testing. To the maximum extent permitted by Florida law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. This section explicitly does NOT exclude any warranties or rights that cannot be excluded under Florida law.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by Florida law, in no event will Owens Water Co., LLC, its members, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages. This includes (without limitation) loss of profits, business interruption, water damage from third-party installation, loss of data, or personal injury caused by third-party contractors. Our total liability for any direct damages will not exceed the amount you paid for the product or service giving rise to the claim. Some jurisdictions do not allow limitation of certain damages; these limitations apply only to the extent permitted.
10. INDEMNIFICATION
You agree to indemnify and hold harmless Owens Water Co., LLC and its members, officers, employees, agents, and affiliates from any claims arising from your misuse of the Site, your violation of these Terms, or your violation of any third-party rights.
11. INTELLECTUAL PROPERTY
All content on the Site (logos, text, images, design, the Owens Water Co. name and brand) is owned by Owens Water Co., LLC or its licensors. You may not copy, reproduce, modify, distribute, or create derivative works without our written permission.
12. THIRD-PARTY LINKS
The Site may link to third-party websites. We do not control or endorse third-party sites. Use of third-party sites is at your own risk and governed by their own terms.
13. PRIVACY
Your use of the Site is also governed by our Privacy Policy, available at owenswater.com/privacy-policy/.
14. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws principles. Any dispute arising from these Terms or your use of the Site will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to non-binding mediation in Lee or Collier County, Florida. If mediation does not resolve the dispute, the parties may pursue any available remedy in the state or federal courts located in Lee or Collier County, Florida. You consent to the exclusive jurisdiction of those courts.
15. CHANGES TO TERMS
We may update these Terms from time to time. The Effective Date at the top reflects the latest update. Material changes will be posted prominently on the Site. Continued use after changes constitutes acceptance.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
